Nebraska Workers’ Compensation
Which Workers Are Covered in Nebraska?
If you are the victim of an injury that occurred while you were working in Nebraska or for a company that headquarters in Nebraska, you probably have the right to workers' compensation benefits under the Nebraska Workers' Compensation Act. You may be eligible for benefits under other states' workers' compensation laws and other labor statutes, too.
The Nebraska Revised Statute § 48-101 reads:
When personal injury is caused to an employee by accident or occupational disease, arising out of and in the course of his or her employment, such employee shall receive compensation therefor from his or her employer if the employee was not willfully negligent at the time of receiving such injury.
That means that if a victim did not purposefully do something that caused the accident, (usually, this means the injured worker was intoxicated at the time of accident) the victim is eligible for workers' compensation benefits. Problems arise when employers or their insurance companies will not pay the benefits that the law says are due, especially when it comes to medical care.
Legal Help for On-the-Job Injuries
Brock Law Offices has a long history of representing clients and their families who need help after an on-the-job accident that result in bodily injuries or death.
- Truckers and truck-company employees
- Construction supervisors
- Construction workers
- Builders & welders
- Plumbers & electricians
Our law firm is known for representing injured truck drivers and motor transport workers, but we also represent a large number of workers in other industries and fields, including construction foremen and workers, construction machinery & other machinery operators, builders, electricians, plumbers, and other kinds of laborers. When these folks are injured on the job as a result of someone else's negligence, sometimes both areas of the law are involved. In other words, the injured employee has two cases, not just one.
We work with attorneys who are admitted in other states, too, and who have clients that have claims against Nebraska-based companies and third parties such as negligent drivers who caused the accident.
We provide compassionate service to our clients and aggressive representation in court, mediation, and other forms of alternative dispute resolution.
At Brock Law Offices, results matter.
